S.C. allowed 27% OBC quota in higher education but creamy layer debarred

The five Judges Constitution Bench of The Supreme Court of India headed by Chief Justice K.G. Balakrishnan has allowed 27% reservation for OBD in higher education institutions disallowing creamy layer earning 2.50 lakhs annual income and more.
Justice Balakrishnan observed 'Hindu Community basically based on caste system and it should be accepted by us.'
Here is to point out that creamy layer formula would not apply in SC/ST reservation. Minority institutions would be out of purview of this judgement.
S.C. observed that 93rd amendment in the Constitution of India does not violate the fundamental structure of the Constitution.
The decision of the Supreme Court of India would facilitate the OBC students who desire to seek admission in higher education like IITs, IIMs, AIIMS etc.

reservation will divide india again.

There should be no reservation untill there are sufficient job opportunities for all. Shortage of job, there is no meaning for reservation.
